The staffer is #MarkoElez, a Dept of #Labor employee detailed to the DOGE entity within the #Trump WH, acc/to a Saturday court filing. It says the Labor Dept is aware of 4 other agencies, including #HHS, where Elez is also detailed or employed.

In an especially strange twist, the case — against #TownstoneFinancial, a small Chicago-based lender — was brought during #Trump’s first term by Kathleen Kraninger, the director he appointed to run the #CFPB.

In this prerogative state, #judges & other legal actors deferred to the #racist hierarchies & ruthless expediencies of the #Nazi regime.

The key here is that this prerogative state does not immediately & completely overrun the normative state. Rather, Fraenkel argued, #dictatorships create a #lawless zone that runs alongside the normative state. The 2 states cohabit uneasily & unstably. On any given day, people or cases could be jerked out of the normative state & into the prerogative one.
