A lawyer who was asked to offer *independent* arguments on the #Justice Dept’s motion to dismiss #corruption charges against #NYC Mayor #EricAdams of told a judge on Friday that he should end the prosecution.

But the lawyer, #PaulClement, said the judge should not allow the Trump admin to use the threat of #criminal charges to compel Adams’ political support.

The judge then turns to #EmilBove’s order to the acting US attorney in Manhattan, #DanielleSassoon, instructing her to abandon the case. The judge asks whether Ho can consider what is in the memo, & Bove says “no.” He says that case #law suggests that Ho does not have the discretion to do so, even as he acknowledges whether a judge is entitled to inquire whether the order was made “in bad faith.”

#EmilBove concedes that #EricAdams can have his security clearance restored even if the case proceeds undermines a central contention in his argument for the case’s dismissal.

In his Feb 13 letter to #DanielleSassoon, the first US atty who resigned, Bove wrote that a lack of security clearance meant, “He cannot speak to federal officials regarding imminent security threats to the city.…This situation is unacceptable & directly endangers the lives of millions of New Yorkers.”

It was #EmilBove who on Mon ordered the US atty in Manhattan, #DanielleSassoon, to move to dismiss the case. She refused &, yesterday, resigned. Several other #DOJ prosecutors also resigned rather than put their names on the motion to dismiss. Now, at the end of the week, #Bove’s own signature is on the motion.

The judge in the case, Dale Ho, will have the opportunity to question the DOJ ofcls, if he chooses to do so, about why to end the prosecution against Mayor #EricAdams.

@jab01701mid yeah i'm surprised that they agreed to turn over the notes, but i suspect there's a lot more to the story behind that footnote that we will learn in due time.

as someone who had the pleasure of observing #DanielleSassoon in action live and and in person during the #SBF / #FTX trial i can attest to the fact that she is an *incredibly* effective communicator. read any of the press about the trial and you will see everyone who watched it observed this to be true. "holy shit that DA Sassoon is fucking crushing this" was like 70% of all discussion during breaks in the trial over in the journalists' section.

#DanielleSassoon also said #EmilBove had scolded a member of her team for taking notes during the meeting & ordered that the notes be collected at the meeting’s end.

Bove accepted Sassoon’s resignation in his own 8pg letter Thurs, in which he blasted her handling of the case & decision to disobey his order.
He told her the prosecutors who had worked on the case against #EricAdams were being placed on leave because they, too, were unwilling to obey his order.

#DanielleSassoon, in a remarkable letter addressed to AG #PamBondi, said #EmilBove’s order to dismiss the case was “inconsistent with my ability & duty to prosecute federal crimes without fear or favor & to advance good-faith arguments before the courts.”

“I have always considered it my obligation to pursue justice impartially, without favor to the wealthy or those who occupy important public office, or harsher treatment for the less powerful,” she said.

Acting dpty AG #EmilBove ordered #DanielleSassoon’s office to drop the charges on Mon, saying a potential trial would come too close to when #EricAdams is seeking reelection & the case could hinder his ability to focus on *fighting* [doing] #crime & illegal #immigration.

But prosecutors so far have not asked the trial judge to dismiss the case. If NY prosecutors refused to do so, it’s possible that #DOJ ofcls would send prosecutors from the #PublicIntegrity section to make the request instead.
